Filing 5 ELECTRONIC ORDER AND NOTICE OF DEFICIENCY. Plaintiff David Lyman Spalding must address the following deficiency: The Court severed Plaintiff's due process claims from a response that he filed in his criminal case, No. 3:13-CR-422-M-1. See Doc. #4 . Plaintiff is now advised that the civil action is subject to the filing fee provisions of the Prison Litigation Reform Act (PLRA). See Complaint form at page 2, paragraph 3 for filing fee information under the PLRA. Accordingly, to the extent that Plaintiff seeks to proceed with a new civil action, he is GRANTED until March 13, 2023 to: (1) file a complaint on the court-approved form and (2) pay filing and administrative fees of $402.00 or file an application to proceed in forma pauperis with the required certificate of inmate trust account. See N.D. Tex. Misc. Ord. 14 (requiring inmates to file civil rights complaints and motions to proceed in forma pauperis on the court-approved forms). If Plaintiff did not intend to file a lawsuit at this time, he may file a Notice of Dismissal and the case will be closed without the assessment of a filing fee. FAILURE TO COMPLY WITH THIS ORDER MAY RESULT IN THE DISMISSAL OF THIS ACTION PURSUANT TO FEDERAL RULE OF CIVIL PROCEDURE 41(b).The Clerk of the Court is directed to provide to Plaintiff, with service of this Order, two prisoner civil rights complaint forms (labeled amended and reflecting this case number) and a prisoner form motion to proceed in forma pauperis.
