Before the Court is Defendant Philadelphia Indemnity Insurance Company's ("Defendant") Motion to Preclude Attorneys Fees and Plea in Abatement Pursuant to Chapter 542A of the Texas Insurance Code. In the Motion, Defendant requests the Court issue an order precluding Plaintiffs Arka Mesquite Investments, LLC and Arka Mesquite Educators, LLC's ("Plaintiffs") from receiving attorneys fees in this action, as requested in Plaintiffs' Original State Court Petition. (Doc. 1-5, pg. 10). The Court concludes that the Motion should be, and therefor is, DENIED without prejudice at this time.
