May 22, 2023 Opinion or Order Filing 9 ELECTRONIC ORDER: The Court ordered both Plaintiff and Defendant to file, respectively, an amended certificate of interested persons/disclosure statement, by May 19, 2023, which complies with newly amended Federal Rule of Civil Procedure 7.1. See Doc. No. 6. Defendant timely filed its amended Certificate of Interested Persons (Doc. No. 8) which satisfies Rule 7.1(a)(2). Plaintiff, however, failed to comply with the Court's order. The Court ORDERS Plaintiff to file an amended certificate of interested persons/disclosure statement which complies with the disclosure requirements of Rule 7.1(a)(2), May 24, 2023 . Failure to comply with this second court order may result in the issuance of an order for Plaintiff to show cause and the imposition of sanctions available under the law. May 12, 2023 Opinion or Order Filing 6 ELECTRONIC ORDER: Defendant removed this case to federal court on the basis of diversity jurisdiction. See Doc. No. 1 at 1. Defendant and Plaintiff timely filed their respective certificates of interested persons/disclosure statements. Doc. Nos. 2 & 5. Rule 7.1 of the Federal Rules of Civil Procedure was recently amended to include a specific disclosure requirement for parties in cases where subject matter jurisdiction is based on diversity under 28 U.S. C. 1332(a). Fed. R. Civ. P. 7.1(a)(2) (effective December 1, 2022). Rule 7.1(a)(2) provides that a party to an action based on diversity shall file a disclosure statement which "must name--and identify the citizenship of--every individual or entity whose citizenship is attributed to that party" at the time the case is removed to federal court and again if any event occurs later which might affect the court's diversity jurisdiction. Id. Neither Defendant's nor Plaintiff's certificate of interested persons/disclosure statement complies with Rule 7.1(a). Thus, both Defendant and Plaintiff are ORDERED to file an amended certificate of interested persons/disclosure statement that includes the required information under Rule 7.1(a) by May 19, 2023.
