Filing 6 ELECTRONIC ORDER: Is venue proper here or in the Eastern District of Texas, Sherman/Plano Division? Yockey claims he was struck by a police car while riding his bike on the campus of the University of Texas at Dallas. The problem is, the county line between Dallas and Collin Counties runs right through campus. And Dallas County is in the Northern District of Texas, while Collin County is in the Eastern District of Texas. (That's right, Texas is so big that even some universities span multiple counties). So the Court asks Yockey to file an amended complaint in 28 days that addresses where on campus the alleged accident occurred and what county it was in. The Court can transfer this case to the Eastern District of Texas if the alleged accident occurred there, or keep the case if it occurred here. (Ordered by Judge Brantley Starr on 10/23/2023) (chmb) |
