FINDINGS, CONCLUSIONS, AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE: Unless Plaintiff David C. Lettieri satisfactorily shows through timely objections a basis to amend the complaint to allege a plausible claim, the Court should dismiss the claim under Section 43(a) of the Lanham Act, 15 U.S.C. 1125(a), with prejudice and relinquish jurisdiction over any remaining state law claims, dismissing those claims without prejudice, to allow Lettieri to pursue them in a state forum if he so chooses.
