Filing 5 ORDER - Pro se plaintiff and Texas prisoner Juan Francisco Turcios filed a 42 U.S.C. 1983 complaint on July 30, 2024. Doc. 3. On August 14, 2024, Turcios filed a "Motion for Dismissal" in which he moves to dismiss his case. Doc. 4. The Court liberally construes the motion for dismissal as a notice of dismissal under Federal Rule of Civil Procedure 41(a)(1)(A)(i) because no opposing party has served an answer or motion for summary judgment. See FED. R. CIV. P. 41(a)(1)(A)(i). Accordingly, the Clerk of Court is instructed to CLOSE this case. (Ordered by Judge Ed Kinkeade on 8/15/2024) (chmb) |
