ORDER: Petitioner's letter request is DENIED as this case is no longer pending and, liberally construed as a new habeas petition brought under 28 U.S.C. 2254, it should be DISMISSED WITHOUT PREJUDICE for failure to exhaust state court remedies. The clerk of the court is directed to (1) open and close a new habeas corpus action under 28 U.S.C. 2254 (nature of suit code 530) against the Sheriff of the Johnson County Jail, (2) directly assign the new action to the same District Judge and Magistrate Judge as this case, and (3) docket a copy of the construed petition (Doc. 17) and this order in the new action. The clerk of the court is also directed to mail to Petitioner a form habeas corpus petition under 28 U.S.C. 2254 and a form motion to proceed in forma pauperis.
