JUDGMENT: It is ordered that Plaintiff Andrew James Wiley ("Plaintiff") take nothing against Defendants State of Texas, Taylor Johnson, Hector Garza, and John Creuzot ("Defendants"); that this action against Defendant Taylor Johnson is dismissed with prejudice; that this action against Defendants State of Texas, Hector Garza, and John Creuzot is dismissed without prejudice; that all relief requested by Plaintiff is denied; and that all relief not expressly granted herein is denied. ORDER: Having considered Plaintiff's pleadings, the file, record in this case, and the #14 Second Supplemental Report, the court determines that the findings and conclusions of the magistrate judge in the Second Supplemental Report are correct, and accepts them as those of the court. Accordingly, the court dismisses with prejudice this action as to the claims by Mr. Wiley against Defendant Taylor Johnson, and dismisses without prejudice this action and the claims by Mr Wiley against Defendants State of Texas, Hector Garza, and John Creuzot. After the magistrate judge filed the Second Supplemental Report, Mr Wiley also filed an #17 Emergency Petition for Temporary Restraining Order ("TRO").
