July 2, 2025 Opinion or Order Filing 18 ELECTRONIC ORDER: This case was transferred to the Northern District of Texas, Dallas Division from the Eastern District of Texas on the parties' agreed motion to transfer. See Doc. No. 12. In the agreed motion to transfer, the parties contend that venue is not proper in the Eastern District of Texas because Defendant The State National Bank of Big Spring's "regular and established place of business is located in Howard County in the Northern District of Texas." Civil Action No. 2:25-CV-0102-JRG (E.D. Tex.), Doc. No. 225 at 2. Howard County is located in the Abilene Division of the Northern District of Texas, not the Dallas Division. 28 U.S.C. ¶ 124(a)(3)."Section 1404 authorizes a district court '[f]or convenience of the parties and witnesses, in the interest of justice' to move venue to any other district or division where the suit might have been brought. Decisions to effect 1404 transfers are committed to the sound discretion of the transferring judge, and.... [s]uch transfers may be made sua sponte." Mills v. Beech Aircraft Corp., Inc., 886 F.2d 758, 761 (5th Cir. 1989) (internal citations omitted). The Court is inclined to transfer sua sponte this case to the Abilene Division. However, prior to doing so, the Court will allow the parties an opportunity to be heard. The parties may each file a brief on the Court's proposed transfer under 1404(a) by July 16, 2025. The parties' respective briefs shall not exceed 15 pages in length (excluding any table of contents and table of authorities) and there shall be no responsive briefs absent further order of the Court. If a party fails to file a brief, the Court will construe that party's silence as non-opposition to the proposed transfer. In light of this Order, Plaintiff Torus Ventures, LLC is relieved of the deadline related to the appearance of local counsel as set forth in the Court's previous order of this same date. Doc. No. 17. Instead, Plaintiff shall file the appearance of local counsel, who complies with Local Civil Rule 83.10(a), if necessary, within 14 days of the Court's determination regarding the transfer of this matter.(Ordered by Judge Ed Kinkeade on 7/2/2025) (chmb)
