| Filing 16 ELECTRONIC ORDER: Upon review of the docket, Plaintiff Vision Sphere Labs LLC's Amended Complaint (Doc. 14) was not filed in accordance with Federal Rule of Civil Procedure 15. Under Rule 15(a)(1), a party may amend its pleading once as a matter of course (1) no later than 21 days after serving it or (2) no later than an answer or a motion under Rule 12(b), (e), or (f) is filed. The docket currently reflects that Defendant Draytek Corporation was served on October 1, 2025. See Doc. 7, Summons Returned Executed. Vision Sphere Labs's Amended Complaint (Doc. 14) was filed on January 5, 2026. On January 20, 2026, Draytek Corporation filed a Rule 12(b) motion to dismiss the Amended Complaint asserting that service was improper. See Doc. 15, Mot. Thus, Vision Sphere Labs filed its Amended Complaint more than 21 days after purportedly serving it and before the Rule 12 motion was served, which means that the Amended Complaint could not have been filed as a matter of course under Rule 15(a). Accordingly, the Court directs the Clerk to STRIKE the Amended Complaint (Doc. 14). In addition, the portion of Draytek Corporation's pending Motion (Doc. 15) seeking to dismiss the Amended Complaint is DENIED AS MOOT. In the Motion, Draytek Corporation alternatively seeks to correct the record to reflect that it has not been properly served. Vision Sphere Labs is ORDERED to respond regarding correction of the record by or before February 10, 2026.
