Filing 40
ELECTRONIC ORDER: Plaintiffs filed their First Amended Complaint (the "Amended Complaint") (Doc. No. 38) on December 24, 2025. The Amended Complaint is signed by Plaintiffs' lead counsel, but it is not also signed by Plaintiffs' local counsel. Doc. No. 38 at 42. Indicating "/s/" above local counsel's signature block does NOT satisfy the signature requirement for this Court. Id.; compare id. (lead counsel's signature "/s/ George E. Hyde").This Court previously directed all counsel of record to review and comply with the undersigned's Judge Specific Requirements and provided a link to those Requirements in the order. Doc. No. 2. Furthermore, in a separate order, the Court specifically pointed out to Plaintiffs the undersigned's requirement that local counsel sign ALL documents filed with the Court and that failure to do so would result in the document being unfiled. Doc. No. 3. Plaintiffs are hereby on notice that any further filings that do not also include the signature of local counsel will be immediately UNFILED without further notice and regardless of any filing-related deadline. Finally, the Court has had to spend time reminding the parties of the undersigned's specific requirements despite the previous order (Doc. No. 2) that counsel review and comply with said requirements. See Doc. Nos. 31 & 35. Accordingly, the Court ORDERS all counsel of record (including local counsel) EACH to file a certification that they have PERSONALLY reviewed, understand, and will comply with this Court's Specific Requirements, as well as the federal and local civil rules, going forward in this and all other matters before this Court. This certification shall be filed by January 5, 2026. Any further instances of non-compliance with this Court's Requirements or the federal and/or local civil rules will result in an order directing the offending party/parties to show cause why they should not be sanctioned. (Ordered by Judge Ed Kinkeade on 12/29/2025) (chmb)

Filing 35
ELECTRONIC ORDER:Before the Court is Plaintiffs' Unopposed Motion for Extension of Time for Plaintiffs to File a Response to Defendants' Partial Motion to Dismiss (Doc. No. 34). As set forth in the undersigned's Judge Specific Requirements, parties must request extensions by formal motion under the applicable standard. See also Doc. No. 2 (Court's standing order directing all counsel to review and comply with Judge Specific Requirements). Plaintiffs do not cite the applicable standard, nor do they state any reason for the requested extension that would establish good cause. See Fed. R. Civ. P. 6(b)(1). The fact that the parties agree to an extension does not in and of itself justify an extension. Because this is the first request and Plaintiffs seek only a two-week extension, the Court GRANTS the Motion.Plaintiffs shall file their response by January 7, 2026. The parties are on notice that any further requests for extensions of time or modifications of court-ordered deadlines shall be made by formal motion under the applicable standard. Failure to comply with this requirement will result in the motion being summarily denied without further notice and regardless of any filing related deadline. (Ordered by Judge Ed Kinkeade on 12/19/2025) (chmb)

Filing 31
ELECTRONIC ORDER: The Court is in receipt of the Joint Stipulation on Defendants' Deadline to File an Answer or a Rule 12 Motion (Doc. No. 30) filed by Plaintiffs and Defendants. The parties stipulate that Defendants' time to answer or otherwise respond is "on or before December 3, 2025." Doc. No. 30 at 2. A waiver of service was sent to each named Defendant on October 3, 2025, and each waiver was executed on October 21, 2025. See Doc. Nos. 12, 13, 14, 15 & 16.Because Defendants waived service, they must answer or otherwise respond within 60 days from October 3, 2025 (the date the waiver was sent), which is December 2, 2025. Fed. R. Civ. P. 4(d)(3). As set forth in the undersigned's Judge Specific Requirement, the Court does not permit parties to stipulate to extensions of any court-ordered deadline or time to act under the federal rules. See Doc. No. 2 (Court's standing order directing all counsel to review, among other things, the undersigned's Judge Specific Requirements.). To the extent the parties "stipulate" to a one-day extension of Defendants' deadline to answer, the Court will this once construe the Joint Stipulation as a motion for extension of time and grant said request. Defendants shall answer or otherwise respond by December 3, 2025.Any stipulations filed after the entry of this Order SHALL be UNFILED without further notice regardless of any filing-related deadline. Any requests for extensions of time or modifications of court-ordered deadlines shall be made by formal motion under the applicable standard, otherwise said motion will be summarily denied. See, e.g., Fed. R. Civ. P. 6(b), 16(b)(4). (Ordered by Judge Ed Kinkeade on 11/26/2025) (chmb)
