ELECTRONIC ORDER:. On November 4, 2025, Plaintiff filed this new civil rights action. However, the complaint and supplement allege no factual bases or causes of action, thus they fail to state a claim. Doc. #3 ; Doc. #4 (referencing a second supplemental pleading not yet filed). Additionally, this new cause of action appears duplicative of Plaintiff's other pending case Leonard v. Thomas, et al., No. 3:24-CV-1780-D-BN, filed July 10, 2024. Should Plaintiff proceed with this new action; a second filing fee will be assessed. As Plaintiff was already granted in forma pauperis status under the Prisoner Litigation Reform Act, which required him to pay the $350 filing fee in monthly installments, the Court finds it appropriate to advise whether he intends to do so before a second filing fee is ordered. Accordingly, Plaintiff is ORDERED to inform the Court whether he intends to proceed with Case No. 3:25-cv-2999-N-BK by December 9, 2025.
