ELECTRONIC ORDER: On February 18, 2026, the judgment of the Court was entered dismissing Plaintiff's claims as barred by the three-strikes provision of 28 U.S.C. 1915(g). Docs. #11 , #12 . Subsequently, the Court received Plaintiff's Motion to Extend Time, which although docketed on February 25, 2026, is deemed filed under the prisoner mailbox rule on the date Plaintiff submitted it to prisoner officials for mailing--February 17, 2026. Doc. #13 at 1. The motion seeks "one more extension of 30 days...." Doc. #13 at 1. Although the motion does not indicate the deadline Plaintiff seeks to extend, the Court liberally construes it as seeking another extension of the deadline to file objections to the Findings, Conclusions, and Recommendation of the United States Magistrate Judge, filed December 18, 2025. Doc. #6 . On Plaintiff's motion, the Court previously extended that deadline to object from January 2, 2026, to February 13, 2026. Doc. 10 . However, Plaintiff failed to file objections by that deadline or timely request another extension of the deadline to do so. FINDINGS, CONCLUSIONS AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE: Kinney's #4 motion to proceed in forma pauperis should be DENIED and this action should be DISMISSED as barred by the three-strike provision of 28 U.S.C. 1915(g). Such dismissal is with prejudice to Kinney refiling an in forma pauperis lawsuit raising the same claims as herein presented, but without prejudice to him refiling this lawsuit with full payment of filing and administrative fees of $405.00. Failure to provide updated address information may result in the dismissal of the case for failure to prosecute or follow court order under Fed. R. Civ. 41(b).
