| Filing 4 ELECTRONIC ORDER: Defendant ASI Lloyds ("ASI") removed this Texas state court action to federal court and seeks to access this Court's diversity jurisdiction under 28 U.S.C. 1332(a). Doc. 1, Notice Removal, 2. "Federal courts are courts of limited jurisdiction." Settlement Funding, L.L.C. v. Rapid Settlements, Ltd., 851 F.3d 530, 537 (5th Cir. 2017) (quoting Howery v. Allstate Ins. Co., 243 F.3d 912, 916 (5th Cir. 2001)). Courts "must presume that a suit lies outside this limited jurisdiction, and the burden of establishing federal jurisdiction rests on the party seeking the federal forum." Id. If the record does not contain sufficient evidence to show that subject-matter jurisdiction exists, the Court does not have jurisdiction over the case. Id. While complete diversity of citizenship appears to exist, the Court finds that the amount in controversy is unclear because the Petition does not allege a "sum certain that exceeds the requisite amount in controversy." Allen v. R & H Oil & Gas Co., 63 F.3d 1326, 1335 (5th Cir. 1995) (citation omitted). Plaintiff seeks "monetary relief of less than two hundred fifty thousand dollars ($250,000.00)." Doc. 1-4, Pet., 2. That statement alone does not present a "sum certain" that would necessarily exceed $75,000. Accordingly, the Court ORDERS ASI, by Friday, March 6, 2026, to SHOW CAUSE in writing why this case should not be dismissed for lack of subject-matter jurisdiction.
