ELECTRONIC ORDER:The Court has an "independent obligation to determine whether subject-matter jurisdiction exists, even in the absence of a challenge from any party." Arbaugh v. Y&H Corp., 546 U.S. 500, 512 (2006) (citation omitted). "The difference between citizenship and residency is a frequent source of confusion." SXSW, L.L.C. v. Fed. Ins. Co., 83 F.4th 405, 407-08 (5th Cir. 2023). For individuals, "an allegation of residency alone does not satisfy the requirement of an allegation of citizenship." Id. (citation modified). While Plaintiffs properly allege their own citizenship in their Original Complaint (Doc. No. 1), they fail to properly allege Defendant Harry Alberto Negron-Ortiz's citizenship. Plaintiffs may amend their complaint to properly allege citizenship no later than September 4, 2026. If Plaintiffs fail to amend or fail to do so sufficiently, the Court will dismiss the case without prejudice and without further notice. See Fed. R. Civ. P. 12(h)(3); Stafford v. Mobil Oil Corp., 945 F.2d 803, 805 (5th Cir. 1991) ("Failure adequately to allege the basis for diversity jurisdiction mandates dismissal."). (Ordered by Judge Ed Kinkeade on 8/27/2026) (chmb)
