May 19, 2026 Opinion or Order Filing 3 ELECTRONIC ORDER denying without prejudice Movant Quentin Lawson's Motion to Compel Christus Health's Compliance with Subpoena and for Order to Show Cause [Dkt. No. 1].In connection with an action pending in the United States District Court for the Eastern District of Texas, No. 6:25-CV-00146-JDK-JDL, Lawson caused a subpoena for document production and a subpoena for deposition testimony to be served on CHRISTUS Health.AICP has filed a motion in the United States District Court for the Northern District of Texas, Dallas Division, seeking orders under Federal Rules of Civil Procedure 45(d) and 45(g) to require CHRISTUS to produce relevant documentary evidence and attend a deposition within 14 days of the order and to show cause why it should not be held in contempt.But, as a threshold matter, motions under Federal Rule of Civil Procedure 45 to compel compliance with a subpoena or to hold in civil contempt a person who, having been served, fails without adequate excuse to obey a subpoena must be brought in the "court for the district where compliance is required." See Fed. R. Civ. P. 45(d)-(g).The subpoenas that were served on CHRISTUS require compliance at a location in Plano, Texas, which is in Collin County. See Dkt. No. 1-2. And Collin County is in the Eastern District of Texas. See 28 U.S.C. 124(c)(3).And, so, any Federal Rule of Civil Procedure 45 motion seeking to compel compliance must be filed in the United States District Court for the Eastern District of Texas, as the "court for the district where compliance [with the subpoenas] is required" as "determined by the location or 'place' for compliance identified on the subpoena as required by [Federal Rule of Civil Procedure] 45(a)(1)(A)(iii)." Fed. R. Civ. P. 45(d), 45(g); CSS, Inc. v. Herrington, 354 F. Supp. 3d 702, 709 (N.D. Tex. 2017); accord Guerrero v. Quality Carriers, Inc., No. 1:23-CV-12-MAC-CLS, 2024 WL 3440243, at *1-*2 (E.D. Tex. May 29, 2024); Johnson v. Air Liquide Large Indus. U.S. L.P., No. 2:18-CV-259-WCB, 2019 WL 4394854, at *3 (E.D. Tex. Sept. 13, 2019); Gee v. Gross, No. 4:18-CV-00369, 2018 WL 2934005, at *2 (E.D. Tex. June 12, 2018); Nexus Display Techs. LLC v. Dell Inc., No. 2:14-CV-762, 2015 WL 13544186, at *1 (E.D. Tex. Nov. 2, 2015); Trover Grp., Inc. v. Dedicated Micros USA, No. 2:13-CV-1047-WCB, 2015 WL 11117083, at *1-*2 (E.D. Tex. Mar. 27, 2015).And, because this Court is not "the court where compliance is required," Federal Rule of Civil Procedure 45(f) provides no authority for this Court to transfer Lawson's motion to the United States District Court for the Eastern District of Texas. Manookian, No. 4:16-CV-00094-ALM, 2016 WL 9274962, at *2*3 (E.D. Tex. Oct. 25, 2016); SynQor, Inc. v. Vicor Corp., No. 3:14-mc-79-D-BN, 2014 WL 2519242, at *2 (N.D. Tex. June 3, 2014).The Court denies Lawson's Motion to Compel Christus Health's Compliance with Subpoena and for Order to Show Cause [Dkt. No. 1] without prejudice to Lawson's refiling in the proper district.And the Clerk of the Court is directed to close this miscellaneous action.(Ordered by Magistrate Judge David L.
