The magistrate judge found that plaintiff's contentions as to the first two issues presented in plaintiff's brief are without merit. The court adopts the magistrate judge& #039;s findings and conclusions as to those issues. However, the court is not adopting the magistrate judge's findings and conclusions as to the issue that caused the magistrate judge to recommend that Commissioner's decision be reversed an d remanded.... The court has concluded that the Commissioner's denial of benefits should be affirmed, and that plaintiff's complaint should be dismissed.
