Filing 21 Memorandum Opinion and Order...the decision of Commissioner that plaintiff was not disabled under sections 216(i) and 223(d) of the Social Security Act is affirmed. The court concludes that the magistrate judge's recommendation of reversal and remand should be rejected. The court disapproves of all proposed findings and conclusions of the magistrate judge that are inconsistent with this memorandum opinion. The court concludes that all arguments made by plaintiff in support of the issues he presentes in his brief are without merit. (Ordered by Judge John McBryde on 3/8/2012) (wrb) |
