Filing 389 OPINION AND ORDER: The Court concludes that the policies Plaintiffs identify fail to provide a basis for the City's liability. This case is tragic and the circumstances of Mr. Waller's death are absolutely heartrending. This order is in no way an approval of the City's policies. The Court merely finds that Plaintiffs failed to produce evidence sufficient to raise a fact issue regarding the demanding standards required in establishing municipal liability. Accordingly, the City's 306 motion must be GRANTED. And for the same reasons, Plaintiffs' motion for summary judgment (ECF No. 313 ) is DENIED.
