Date Filed Document Text
January 25, 2021 Opinion or Order Filing 390 AMENDED OPINION AND ORDER: This Amended Opinion and Order replaces in its entirety the Opinion and Order issued in this case on January 22, 2021. ECF No. 389 . This Amended Opinion and Order merely corrects non-substantive grammatical errors in the earlier Opinion and Order. (Ordered by Judge Mark Pittman on 1/25/2021) (tln)
January 22, 2021 Opinion or Order Filing 389 OPINION AND ORDER: The Court concludes that the policies Plaintiffs identify fail to provide a basis for the City's liability. This case is tragic and the circumstances of Mr. Waller's death are absolutely heartrending. This order is in no way an approval of the City's policies. The Court merely finds that Plaintiffs failed to produce evidence sufficient to raise a fact issue regarding the demanding standards required in establishing municipal liability. Accordingly, the City's 306 motion must be GRANTED. And for the same reasons, Plaintiffs' motion for summary judgment (ECF No. 313 ) is DENIED. (see order for specifics) (Ordered by Judge Mark Pittman on 1/22/2021) (tln)
April 12, 2018 Opinion or Order Filing 201 MEMORANDUM OPINION AND ORDER: Based on the foregoing, the Court GRANTS Defendants' motion for summary judgment (doc. 153 ) and concludes that detectives Green and Baggott are entitled to qualified immunity for all claims asserted against them. (Ordered by Senior Judge Terry R Means on 4/12/2018) (tln)
October 2, 2015 Opinion or Order Filing 112 Memorandum Opinion and Order granting 49 MOTION Motion & Brief to Stay Discovery and 61] MOTION to Stay Discovery (See order for specifics) (Ordered by Magistrate Judge David L Horan on 10/2/2015) (mcrd)
