Memorandum Opinion and Order granting 23 MOTION for Partial Summary Judgment. The court ORDERS that defendant's motion for partial summary judgment be, and is hereby, granted in part as to the negligence per se allegations of the amended complaint and plaintiff will not pursue these allegations at trial.
