Plaintiffs allege that the Patient Protection and Affordable Care Act (ACA) became unlawful after President Trump signed the Tax Cuts and Jobs Act of 2017, which eliminated the tax penalty of the ACA. Plaintiffs contend that without the tax penalty, the individual mandate becomes unconstitutional. Plaintiffs conclude that since the individual mandate was essential to the ACA, the remainder of the ACA must also fall since the guaranteed issue and community rating requirements would not function without the coverage requirement.
