August 2, 2018 Opinion or Order Filing 1 ORDER as to Jeannie Lee Tamez re: 144 correspondence. Defendant contends the Bureau of Prisons failed to award her credit for 21 months and 7 days for prior state custody. The proper procedural vehicle for challenging the execution of a federal sentence or for obtaining credit for prior custody is a petition for writ of habeas corpus pursuant to 28 U.S.C. 2241. Defendant's filing is therefore properly construed as a 2241 petition. The Clerk of the Court is DIRECTED to (1) open a new 2241 habeas case; (2) directly assign the new case to the same District Judge and Magistrate Judge as this case; (3) file a copy of this order in that new case; and (4) file the defendants letter as a 2241 petition filed 6/26/2018, in that new case. (Ordered by Magistrate Judge Irma Carrillo Ramirez on 8/2/2018) (epm)
