FINAL JUDGMENT... In accordance with the order issued this same day, the notice of partial dismissal filed on March 12, 2019, and Federal Rule of Civil Procedure 58, all claims against Paul A. Janiak are hereby DISMISSED WITHOUT PREJUDICE to their refiling. Additionally, judgment is hereby GRANTED in favor of Plaintiff, and against the remaining defendants, jointly and severally, in the total amount of $237,559.06 (itemized as $209,903.38 in principal, plus $15,000.00 in attorneys fees, and $12,255.68 in finance charges calculated at the annual rate of 18% from the date each invoice became due through March, 2019), plus filing fees of $400.00 plus post judgment interest at the annual rate of 18%, and all of which qualifies for trust protection under the trust provision of Perishable Agricultural Commodities Act (PACA), 7 U.S.C. 499e, et seq.
