ORDER DENYING MOTION FOR COUNSEL and FILING FEE ORDER: Plaintiff is GRANTED leave to proceed in forma pauperis pursuant to 28 U.S.C. 1915 such that his motion to proceed in forma pauperis (ECF No. #2 ) is GRANTED. It is ORDERED that the motion for appointment of counsel (ECF No. #3 ) is DENIED. The agency having custody of Plaintiff shall, when funds exist in plaintiff's inmate trust account, forward to the Court an initial partial filing fee of $2.50. Plaintiff shall pay $347.50, the balance of the filing fee, in monthly installments.
