ORDER... Before the Court is the Notice of Removal (ECF No. 1), filed November 24, 2020. According to the Notice, the Court has diversity jurisdiction over the matter because Nautilus filed its election of liability and motion to dismiss pursuant to Chapter 542A.006(a) of the Texas Insurance on November 16, 2020, so the state district court is required to dismiss Plaintiffs claims against Marc Rodriguez with prejudice. ECF No. 1. Based on the record, it remains unclear whether the state district court ever dismissed Plaintiffs claims against Marc Rodriguez. Accordingly, the Court ORDERS Defendant to file a notice of whether the state district court dismissed the claims against Marc Rodriguez, and if so, ORDERS Defendant to supplement the record with that information on or before November 25, 2020.
