After considering the Motion to Remand and the applicable law, the Court will GRANT the Motion. Having reviewed the Notice of Removal, the Motion to Remand, and the applicable law, the Court concludes that Scotts' removal was defective. Therefore, the Court GRANTS Plaintiffs Motion to Remand Proceedings to State Court.
