ORDER DENYING PETITIONER'S REQUEST FOR APPOINTMENT OF COUNSEL: Before the Court is Petitioner's motion #2 to appoint counsel to assist him with his motion to vacate his sentence under 28 U.S.C. 2255. After consideration of the motion and the applicable law, the Court concludes that the motion should be, and it is hereby, DENIED because a prisoner has no constitutional or statutory right to counsel during post-conviction proceedings, unless an evidentiary hearing is held to assess the merits of the petition.
