Filing 15 CORRESPONDENCE filed by James S. Gorman. (tjc) |
Filing 14 FINAL JUDGMENT: In accordance with the Courts order of dismissal entered this day and Federal Rule of Civil Procedure 58, it is the final judgment of the Court that James S. Gorman's petition for a writ of habeas corpus under 28 U.S.C. 2241 is DISMISSED. See FED. R. CIV. P. 58. (Ordered by Judge Mark Pittman on 2/27/2023) (tjc) |
Filing 13 ORDER: Petitioner James S. Gorman is a pretrial detainee confined in Tarrant County Jail, where he is awaiting trial on a state aggravated-sexual-assault charge. In this 28 U.S.C. 2241 habeas petition, Gorman claims that his pretrial detention is unlawful. Proceeding pro se and in forma pauperis, Gorman asks the Court to dismiss his pending criminal charge. For the following reasons, the Court DISMISSES Gorman's habeas petition. Gormans motion for an extension of time to file his 2241 petition is DENIED as moot and unnecessary. See ECF No. #10 . The clerk of Court received and docketed Gormans 2241 petition on February 14. (Ordered by Judge Mark Pittman on 2/27/2023) (tjc) |

Filing 5 ORDER: James S. Gorman must address the following deficiency: The Court ordered Gorman to file his 2241 petition on the proper form and either pay the $5 filing fee or file the required in forma pauperis documents by February 9. To date, Gorman has not complied with the Court's order or sought an extension of time to do so. Gorman's noncompliance suggests that he may not want to proceed with this action. Nevertheless, the Court will provide him an additional 14 days to comply. Failure to comply with this order may lead to dismissal for failure to prosecute pursuant to FRCvP 41(b). Deadline to cure the deficiency is 3/1/2023. (Ordered by Judge Mark Pittman on 2/15/2023) (tjc) Docket text modified on 2/15/2023 (twd). |
