It is further ORDERED that the Motion to Dismiss for Prosecutorial Misconduct (ECF No. #9 ) is DENIED without prejudice to Blake including any arguments raised therein in a re-filed 2241 form petition and brief. It is further ORDERED that the time for Blake to comply with the Court's prior order to complete and file a 2241 form petition with a supporting brief not to exceed 35 pages, is extended until May 25, 2023.
