October 12, 2023 Opinion or Order Filing 9 ORDER granting #8 Motion to Extend Time. After review, the Court GRANTS Dingler's motion for leave. Dingler must file his motion by November 10, 2023. The Court will not grant any further extensions of time. Dingler's request for the Court to order the sheriff to provide him a copy of his inmate account statement is DENIED. It is Dingler's responsibility to obtain a copy of his inmate account statement. However, Dingler may present a copy of the Court's August 30 to the appropriate jail officials to expedite any such request he should make. (Ordered by Judge Reed C. O'Connor on 10/12/2023) (tjc)

August 30, 2023 Opinion or Order Filing 7 ORDER: After reviewing Dingler's petition and memorandum, the Court CONSTRUES this action as a civil-rights complaint under 42 U.S.C. 1983. If Dinlger intends to proceed with this civil-rights action, he must do the following within 30 days: (1) file his complaint on the form provided by the Court; and (2) either pay the $402 filing fee or file a proper application to proceed in forma pauperis and a certified copy of his inmate account. Failure to comply with this order may lead to dismissal for failure to prosecute pursuant to FRCvP 41(b). To the extent that Dingler intends to challenge the fact or duration of his pretrial detention in this newly construed civil-rights action, his claims are DISMISSED without prejudice as not cognizable under 1983.
