Filing 14 ORDER: Before the Court are Plaintiff's applications to proceed in forma pauperis in this civil-rights action. See ECF Nos. 10, 12. After review, the Court GRANTS Plaintiffs applications and ORDERS the that Plaintiff will not be assessed an initial partial filing fee because he lacks the requisite funds in his inmate trust account to pay an initial fee. However, Plaintiff will be required to pay the full filing fee of $350.00. (Clerk to mail a copy to the inmate accounting office). (Ordered by Judge Mark Pittman on 11/7/2023) (tjc) |
Filing 13 ORDER: The Court concludes that Samuelson's claims must be separated into two different actions. Samuelson's civil-rights claims will proceed in this action, and his habeas claims will be severed and considered in a new civil action. The Court DIRECTS the clerk of Court to: (1) open a new civil action (Nature of Suit 530) (4:23-cv-01126-O opened); and (2) docket a copy of Samuelson's habeas petition (ECF No. #11 ), application to proceed in forma pauperis (ECF No. #12 ); and this order in the new civil action. Samuelson's civil-rights claims to recover monetary damages remain pending in this action and will be adjudicated in due course.
