Filing 6 FINAL JUDGMENT: Consistent with the order of dismissal signed this date, the petition of Oluwaseun Shomefun for writ of habeas corpus under 28 U.S.C. 2241 is DISMISSED for want of jurisdiction. (Ordered by Judge Reed C. O'Connor on 11/8/2023) (sre) |
Filing 5 ORDER OF DISMISSAL: Petitioner, Oluwaseun Shomefun, filed a document purporting to be a petition for writ of habeas corpus under 28 U.S.C. 2241. The document reflects, however, that it is really an attempt to appeal from the decision of the Board of Immigration Appeals affirming the denial of bond pending Petitioner's final removal from the United States. Petitioner admits that he has filed a motion to reopen, which is now pending. ECF No. #1 at 5. Thus, any appeal is premature. In addition, the appeal would be to the United States Court of Appeals for the Fifth Circuit. See Djiev. Garland, 39 F.4th 280 (5th Cir. 2022); Zhao v. Gonzales, 404 F.3d 296, 30304 (5th Cir. 2005). (Ordered by Judge Reed C. O'Connor on 11/8/2023) (sre) |
