April 17, 2024 Opinion or Order Filing 9 ORDER RESOLVING MOTIONS: Pending before this Court in this case is a petition for writ of habeas corpus under 28 U.S.C. 2241 filed by FMC-Fort Worth petitioner, Joel Vargas. The Court has just received the petition and will issue a show cause/service order upon the Respondent. Now pending is a motion for evidentiary hearing filed by Vargas. ECF No. #5 . Until the Court has a chance to review Vargas's claims and the response thereto, the motion for hearing is premature, and must be denied. Also pending is a motion by Vargas requesting that the Court serve all documents upon him via certified mail. ECF No. #3 . There is no basis for this request, and the Court is confident Vargas will receive all documents at his institutional address with sufficient time to respond. Thus, the motion regarding certified mail must be denied. It is therefore ORDERED that the motion for evidentiary hearing and motion regarding receipt of documents by certified mail (ECF Nos. #3 and #5 ), are DENIED.
