ELECTRONIC ORDER finding as moot #16 Defendants' Motion to Stay Pursuant to Stay Pursuant to Carswell. In the motion, Defendants Kevin Blasingame, Nadine Dauman, Kristopher Donahey, Shawn Evans, Joselin Frias, Jake Montgomery, Darrin Parr, Joel Perez, Sterling Rochester, and Joseph Smith (hereinafter collectively referred to as the "Individual Defendants") request that all discovery in this case be stayed pursuant to Carswell v. Camp, 54 F.4th 307 (5th Cir. 2022), as such Defendants have asserted the defense of qualified immunity in their pending Federal Rule of Civil Procedure ("Rule") 12(b)(6) motions to dismiss. However, Plaintiff filed an amended complaint on August 18, 2025. Thus, the undersigned recommended, inter alia, that the Individual Defendants' motions to dismiss based on Rule 12(b)(6) be denied as moot. In addition, the undersigned recommended that that Plaintiff be given additional time to properly serve the Individual Defendants. Consequently, the motion to stay should be denied as moot at this time.
