February 3, 2026 Opinion or Order MINUTE ORDER granting #35 Motion to Transfer Case. The Court ORDERS transfer of this case to the Northern District of Texas. Venue is proper as to Plaintiff's FTCA claim only in the Northern District of Texas, where the alleged injuries took place, or in the Northern District of Minnesota, where Plaintiff is currently incarcerated. 28 U.S.C. 1402(b). "The location of the agency's headquarters office does not establish venue in this district." Simpson v. Fed. Bureau of Prisons, 496 F. Supp. 2d 187, 193 (D.D.C. 2007). Because the alleged events took place at FMC Carswell, the Northern District of Texas is the most proper venue.As to Plaintiff's Trafficking Victims Protection Act claim, the Court agrees that Holland v. United States, No. 25-cv-589, Dkt. 11 (D.D.C. July 29, 2025), provides the correct analysis. Naming the head of the BOP and high-level Government officials as Defendants does not "manufacture venue in the District of Columbia," when Plaintiff's allegations concern the actions of a BOP employee at FMC Carswell.
