The State of Texas is suing the Equal Employment Opportunity Commission (EEOC) for enforcement guidelines it promulgated suggesting that employers relying on arrest records and criminal convictions can have a disparate impact on certain racial groups, in violation of federal employment law. Texas argues that the EEOC's guidelines infringe on the state's authority to impose blanket bans on hiring convicted felons in certain employment positions.
