December 6, 2018 Opinion or Order Filing 10 ORDER denying #2 Motion for Leave to Proceed In Forma Pauperis. Because Plaintiff has had three prior strikes, he cannot proceed in forma pauperis in the instant action unless he demonstrates that he was "under imminent danger of serious physical injury" at the time he signed and dated his complaint. The Court finds that Plaintiff has failed to demonstrate that he was "under imminentdanger of serious physical injury" when he filed his civil rights action; therefore, he cannot proceed informa pauperis, and he must pay the full filing fee of $400.00 if he desires to pursue his complaint. It is, therefore, ORDERED that Plaintiff shall pay the filing fee of $400.00 within twenty (20) days of the date of this Order. (Ordered by Senior Judge Sam R Cummings on 12/6/2018) (bmg)
