The undersigned further recommends that the United States District Court dismiss with prejudice Santos's claim seeking damages on the basis that Officer Welty falsified his police report. The undersigned further recommends that the United States District Court order Detective Mondragon, or the officer identified by the City of Lubbock in response to this Court's order of even date, to answer or otherwise plead to Santos's claim of excessive force.
