October 13, 2021 Opinion or Order Filing 5 NOTICE OF RECHARACTERIZATION AND FILING FEE DEFICIENCY AND ORDER: Petitioner Christopher Tyrone Jones filed a handwritten document titled "l1.07 Out of Time." (Doc. 1 ). To the extent that he asks the Court to extend the statutory deadline for filing a federal habeas petition, the request must be denied. But because it is clear that Petitioner seeks to challenge his state court conviction and sentence, the Court notifies Petitioner of its intent to recharacterize the motion as a habeas petition filed under 28 U.S.C. 2254. If Petitioner wishes to proceed with this petition, he must file an amended petition on the required form, setting out all of his grounds for relief. If not, Petitioner will be permitted to withdraw his petition by filing a notice of withdrawal with the Court. The Court, therefore, orders Petitioner to (l) file a complete amended petition on the court approved form or notify the Court that he is withdrawing his petition and must also pay the filing fee or file an application to proceed in forma pauperis with a certificate of his inmate trust account. Deadline to cure deficiencies is 30 days from the date of this order. If Petitioner fails to comply with is order, the Court may dismiss this action without further notice.
