So, the Court will entertain his newly raised habeas claims in a separate civil action ( 5:21-CV-293-C). The Clerk is directed to open a new habeas action under 28 U.S.C. 2241 (Nature of Suit 530), styled Hugo Alfonso Castillo-Olguin v. Warden Martin Friend, with Plaintiff's Statement of Facts and Motion to Lift Immigration Detainer (Dkt. No. 7) as the initiating document. The Clerk is directed to also file a copy of Plaintiff's motion to proceed in forma pauperis and his certificate of inmate trust account in the new habeas action. Plaintiff's challenges to the execution of his sentence, with his requests for time credits and his request to lift his immigration detainer will be considered in the new habeas action. Plaintiff's conditions-of-confinement claims with his requests for monetary damages and injunctive relief will proceed in this civil action.
