ORDER: The Court intends to recharacterize this petition as a civil rights complaint. Petitioner must file his objections, if any, within 20 days of the date of this Order. If Petitioner objects, he must either show cause why the case should proceed as a habeas action or file a notice of voluntary dismissal under Federal Rule of Civil Procedure 41. Additionally, because Petitioner's claims are properly considered as a civil rights complaint, the fee provisions of the Prison Litigation Reform Act will apply. 28 U.S.C. 1915. So, if Petitioner agrees with the Court's construction of the claims, he must pay the $402.00r or file the following within 20 days from the date of this Order. A certified copy of his inmate trust account statement and a complete Amended Complaint set forth on the form provided by the Court.
