ORDER: The Court intends to recharacterize this petition as a civil rights complaint. Petitioner must file his objections, if any, within 20 days of the date of this Order. If Petitioner objects, he must either show cause why the case should proceed as a habeas action or file a notice of voluntary dismissal under Federal Rule of Civil Procedure 41. If Petitioner agrees with the Court's construction of the claims, he must pay the balance of the $402.00 or file the following within 20 days from the date of this Order: A signed Application to Proceed in Forma Pauperis; A certified copy of his inmate trust account; A signed copy of the AUTHORIZATION portion of the certificate of inmate trust account and a complete amended complaint set forth on the form provided by the Court.
