December 8, 2021 Opinion or Order Filing 5 DEFICIENCY SHOW CAUSE ORDER: It is, therefore, ORDERED that Petitioner must, within 14 days of the date of this 0rder: file a response accepting or objecting to the Court's intended recharacterization of this case as a civil rights complaint, and if agrees to the recharacterization, he must file a complete amended complaint on the required form, and pay the remaining $397.00 balance of filing fee or file an application to proceed n forma pauperis with a certificate of inmate trust account, and show cause why his case should not be dismissed for want of prosecution under FRCvP 41(b) because of his failure to respond to the Court's Order. Additionally, the Court reminds Petitioner that he must promptly notify the Court of any change of address by filing a written notice of change of address with the Clerk. Failure to file such notice may result in this case being dismissed for want of prosecution. The failure of Petitioner to respond to this Order shall result in the dismissal of this cause without further notice. (Ordered by Senior Judge Sam R Cummings on 12/8/2021) (lkw)

October 25, 2021 Opinion or Order Filing 4 ORDER: Thus, the Court intends to recharacterize this petition as a civil rights complaint. Petitioner must file his objections, if any, within 20 days of the date of this Order. So, if Petitioner agrees with the Court's construction of the claims, he must pay the $402.00, or file the following within 20 days from the date of this Order: A signed Application to Proceed in Forma Pauperis; A certified copy of his inmate trust account statement; A signed copy of the AUTHORIZATION portion of the Certificate of Inmate Trust Account or a signed copy of any consent; A complete Amended Complaint set forth on the form provided by the Court.
