Filing 9 Resident Account Summary Report re: #8 MOTION for Leave to Proceed in forma pauperis filed by Louis Gonzales. (bmh) |
Filing 8 MOTION for Leave to Proceed in forma pauperis with Resident Account Summary filed by Louis Gonzales. (bmh) |
Filing 7 JUDGMENT: It is ordered, adjudged, and decreed that Plaintiff's civil-rights complaint is dismissed pursuant to the three-strikes provision of 28 U.S.C. 1915(g). (Ordered by Judge James Wesley Hendrix on 11/4/2022) (bmh) |
Filing 6 ORDER DISMISSING CASE: Plaintiff's claims do not present a claim of imminent danger of serious physical injury. Therefore, he is not entitled to proceed in forma pauperis, and the motion is denied. Plaintiff cannot proceed with this complaint without prepayment of the $402.00 filing and administrative fees. For the foregoing reasons, this action is dismissed without prejudice as barred by the three-strikes provision of 28 U.S.C. 1915(g). The Court notes that Plaintiff's claims appear similar to claims that he has already raised in this Court, and that the Court has already found to be frivolous or malicious. And, as noted above, Plaintiff's pleadings contain thinly veiled threats, profanity, and other offensive or abusive language. Plaintiff is warned that further abuse of the judicial process by filing frivolous and malicious lawsuits will result in the imposition of sanctions, including monetary sanctions and/ or a complete bar to filing civil actions in this Court. (Ordered by Judge James Wesley Hendrix on 11/4/2022) (bmh) |
