June 7, 2023 Opinion or Order Filing 2 ORDER: The Court finds: 1. Petitioners civil-rights claims under 42 U.S.C. 1983 are severed from the instant habeas action. 2. The Clerk is directed to open a new civil action (Nature of Suit 550) and assign it to the undersigned United States District Judge. The Clerk is directed to file a copy of the amended petition (Dkt. No. 5) as the initiating document and a copy of this order in the new civil action. 3. Petitioner must, within 30 days of the date of this order: (i) pay the filing fee of $402.00, and (ii) submit a complete amended complaint. The amended complaint will take the place of the prior complaint and must be signed. Plaintiffs failure to pay the filing fee or file the required amended complaint will result in dismissal of that plaintiffs complaint for want of prosecution without further notice.
