ORDER TO SHOW CAUSE: As of the date of this Order, Plaintiffs have not yet amended their complaint. The Court finds that no later than October 6, 2023, Plaintiffs must (1) file an amended complaint complying with this Court's August 28, 2023 order, and (2) show good cause for the failure to timely file an amended complaint. Plaintiffs are advised that should they fail to amend their complaint as well as provide sufficient explanation for their delay in doing so, the Court will recommend dismissal of their Complaint and all claims therein in accordance with Rule 41 (b). ORDER: The Court therefore ORDERS the Fishers to file an amended complaint no later than September 8, 2023, alleging with specificity the facts necessary to establish the Court's subject matter jurisdiction under either 28 U.S.C. 1331 or 1332. The Fishers are further ORDERED to plead a basis for the Court to find that federal and/or state law allows them to assert the children's claims as their own. Finally, it is ORDERED that all Plaintiffs in this action must sign any amended pleading in accordance with Rule 11(a). Plaintiffs' failure to comply with this Order may result in a recommendation that this action be dismissed without further notice. (Ordered by Magistrate Judge D.
