February 9, 2024 Opinion or Order Filing 8 DEFICIENCY SHOW CAUSE ORDER: The Court finds that Petitioner shall have 20 days from the date of this order to either pay the $5 filing fee or file a compliant certified copy of his inmate trust account; or file a sworn affidavit or unsworn declaration made under penalty of perjury pursuant to 28 U.S.C. 1746, setting forth the specific steps he has taken to attempt to comply with the prior order, or his reasons for failing to comply; and attach copies of any relevant consent forms or other supporting information to Petitioner's sworn affidavit or unsworn declaration. Petitioner is reminded that making false statements in his pleadings may result in sanctions being imposed against him, including dismissal of this action with or without prejudice. Petitioner is also reminded that making false statements in an affidavit or unsworn declaration made under penalty of perjury may result in prosecution for perjury. January 8, 2024 Opinion or Order Filing 4 ELECTRONIC ORDER AND NOTICE OF DEFICIENCY: Petitioner filed a handwritten document that the Court interprets as a pretrial petition for writ of habeas corpus. Petitioner did not file the petition on the appropriate form. Nor did he pay the required $5.00 filing fee or submit a proper request to proceed in forma pauperis (IFP) along with a certified statement of his inmate trust account. See 28 U.S.C. 1915(a)(2). Therefore, Petitioner is ORDERED (1) to complete and return the enclosed form used in this Court for actions filed under 28 U.S.C. 2241, and (2) to pay the $5.00 filing fee or submit an IFP application with the required certificate of inmate trust account, by February 7, 2024 (30 days). Petitioner's failure to comply with this order may result in the dismissal of this action pursuant to Federal Rule of Civil Procedure 41(b).
