Filing 12 NOTICE OF INTENT TO REDESIGNATE CASE: After reviewing Plaintiffs complaint, the Court finds that he does not challenge the conditions of his confinement. Instead, he challenges the validity of his arrest and the currentcharges pending against him. The Court finds that the essence of Plaintiffs complaint is a challenge to the fact of his confinement and that his request for compensation is a secondary form of relief. The primary relief that Plaintiff seeks is available only under the habeas corpus statutes. Therefore, Plaintiff must respond to this order, indicating either his acceptance of or objection to the Court's intended construction of this case within 20 days.
