ORDER: The Court orders the following:(1) Steven Mongeau's Section 1983 claims are dismissed with prejudice as malicious under 28 U.S.C. 1915(e)(2)(B)(ii). (2) To the extent that Mongeau intends to raise any state law claims, they are dismissed without prejudice for lack of jurisdiction. (3) Dismissal of this action does not release Mongeau or the institution where he is incarcerated from the obligation to pay any filing fee previously imposed. (4) This dismissal shall count as a "strike" under 28 U.S.C. 1915 and Adepegba v Hammons, 103 F.3d 383, 385 (5th Cir. 1996). (5) All relief not expressly granted is denied, and any pending motions are denied. (6) Mongeau is advised that if he appeals this order, he will be required to either pay the $605 appellate filing fee or file an IFP application and a 6-month certificate of inmate trust account at the same time he files his notice of appeal.
