Laxon; Case Mgr. Garcia and Chief of Security Gonzalez; Dism'd w/prejudice claims against Defendants in their individual or super visory capacity for subjection to cruel and unusual punishment in the form of deliberate indifference to Plaintiff's health/safety and deliberate indiference to his serious medical needs; Dism'd w/prejudice as to Defendants Felts/Gonzalez t o claims of cruel and unusual punishment in the form of excessive use of force; Dism'd w/prejudice claims against any Defendant in his/her official capacity; Changing caption of case reflecting Defendants Waddell, Chavez, Chavez, Jr., and Villar eal, Jr. as the only remaining Defendants. Further ordering the Clerk to issue summons for these remaining Defendants, the Marshall to serve same and return service. The remaining Defendants to answer within THIRTY (30) DAYS after service.
